Terms of Service

These Terms of Service ("Terms") govern your access to and use of DealFYND.ai, a multi-tenant software-as-a-service platform for real estate investors and acquisition teams, including our website, web application, APIs, SMS and voice messaging, call recording, lead and property intelligence, CRM workflows, and AI-assisted recommendations (collectively, the "Service"). By creating an account or using the Service, you ("Customer") agree to these Terms.

You must provide accurate registration information and are responsible for maintaining the confidentiality of your credentials and for all activity under your account and within your workspace, including activity by users you invite. You must be at least 18 years old to use the Service.

Subscription plans are billed in advance on a recurring basis and renew automatically until cancelled. Phone numbers, messaging traffic, voice minutes, call recording storage, and other usage-based fees are billed according to the pricing in effect at the time of use. Fees and prepaid balances are non-refundable except where required by law. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period, and phone numbers may be released upon cancellation.

When you use the Service to send SMS messages or place voice calls to your own leads and contacts, you are the message sender and caller for legal and carrier purposes. You are solely responsible for:

• Obtaining and documenting prior express written consent (or other legally sufficient consent) from each recipient before sending marketing or promotional SMS, and prior express consent before placing non-emergency autodialed calls or texts.
• Complying with the TCPA, CAN-SPAM Act, CTIA Messaging Principles and Best Practices, A2P 10DLC brand and campaign registration requirements, state telemarketing and two-party call-recording laws, and all other applicable federal, state, and local laws and carrier requirements.
• Honoring opt-out requests (including STOP, UNSUBSCRIBE, CANCEL, QUIT, and equivalents) immediately and not re-messaging opted-out recipients.
• Providing required identification (e.g., your business name) and HELP / STOP instructions in your messaging programs.
• Providing any disclosures and obtaining any consents required by federal or state law before recording or transcribing a call.

You agree not to use the Service to send or place:

• Unsolicited, unlawful, harassing, deceptive, fraudulent, or misleading communications.
• Messages or calls to recipients on purchased, rented, scraped, or otherwise non-consented lists.
• Content prohibited by the CTIA or carriers, including content related to sex, hate, alcohol, firearms, tobacco, cannabis, illegal substances, or unlawful financial schemes.
• High-volume messaging without a properly registered A2P 10DLC brand and campaign tied to your workspace.

You also agree not to interfere with the Service, attempt unauthorized access to other accounts or systems, or infringe intellectual property rights.

We may suspend or terminate your access, throttle messaging, release phone numbers, or pause an A2P campaign without prior notice if we reasonably believe you have violated these Terms, generated carrier or recipient complaints, triggered spam or fraud flags, or otherwise put the Service or our subprocessors at risk. We may also suspend the account for non-payment. You may stop using the Service at any time.

SMS messages that DealFYND.ai sends to you are governed by our SMS Policy, which describes consent, message frequency, message and data rates, and how to reply HELP for help or STOP to unsubscribe.

You retain all rights to the data and content you upload to the Service, including leads, contacts, messages, recordings, and transcripts. You grant DealFYND.ai a limited license to host, process, transmit, and back up that content solely to provide and support the Service to you.

Your use of the Service is also governed by our Privacy Policy. We do not sell personal information and do not share mobile numbers or SMS opt-in consent with third parties for their marketing or promotional purposes.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law. Message and call delivery depends on carriers and is not guaranteed.

To the maximum extent permitted by law, DealFYND.ai will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. Our aggregate liability for any claim arising out of or relating to the Service will not exceed the amounts you paid us for the Service in the twelve months preceding the claim.

You agree to indemnify and hold DealFYND.ai harmless from any claims, damages, fines, or expenses (including reasonable attorneys' fees) arising out of your messaging or calling activity, your contact lists, your consent practices, or your violation of these Terms or applicable law.

We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
